These Terms of Service (“Terms”) govern your access to and use of www.suncoasttrimclinic.com (the “Website”) and the services offered by Suncoast Trim Clinic, LLC (“Suncoast Trim Clinic,” “STC,” “we,” “us,” or “our”).

By accessing this Website or using our services, you agree to be legally bound by these Terms. If you do not agree, discontinue use immediately.

1. Acceptance of Terms

By accessing or using the Website or our services, you confirm that you have read, understood, and agree to comply with these Terms and all applicable laws and regulations.

2. Nature of Services

Suncoast Trim Clinic, LLC is a self-pay telehealth facilitation and support platform.

STC:

  • Does not practice medicine
  • Does not employ providers for the purpose of delivering medical care
  • Does not make medical decisions
  • Does not manufacture, compound, dispense, or ship medications

Medical services, including evaluation, diagnosis, prescribing, and treatment decisions, are provided solely by independently licensed healthcare providers (“Providers”) who exercise independent clinical judgment.

Any provider-patient relationship is formed exclusively between you and the licensed Provider.

3. No Medical Advice

Content on this Website is provided for informational purposes only and does not constitute medical advice, diagnosis, or treatment.

Use of this Website does not establish a provider-patient relationship. A provider-patient relationship is established only after a licensed Provider conducts an evaluation and agrees to provide care.

The services facilitated through this Website are not intended for emergency or urgent medical conditions. If you believe you are experiencing a medical emergency, call 911 or seek immediate medical attention.

Always seek advice from a licensed healthcare professional regarding medical conditions or treatment decisions.

4. Telehealth Services

Telehealth services are available only in states where licensed Providers are authorized to practice.

Participation in introductory calls, educational sessions, or administrative onboarding does not constitute medical care.

Eligibility for treatment, prescriptions, and clinical decisions are determined solely by a licensed Provider following individualized evaluation.

Enrollment does not guarantee approval for treatment or issuance of a prescription. No membership or program fees are charged unless a prescription is issued.

5. Medications & Regulatory Disclosure

A. FDA-Approved Medications

If prescribed, brand-name GLP-1 medications are FDA-approved and prescribed only when deemed medically appropriate by a licensed Provider in accordance with FDA-approved labeling.

STC does not control pharmacy pricing, inventory, manufacturer programs, insurance determinations, or shipping timelines.

B. Compounded Medications

Certain treatment plans may involve custom-compounded medications.

Compounded medications:

  • Are not approved by the U.S. Food and Drug Administration (FDA)
  • Are not reviewed by the FDA for safety, effectiveness, or quality prior to dispensing
  • Are prepared by licensed compounding pharmacies pursuant to valid patient-specific prescriptions
  • May differ from commercially available FDA-approved medications

You will receive a separate medication-specific informed consent if a compounded medication is prescribed.

6. Payment & Program Policies

A. Self-Pay Model

STC is a self-pay platform and does not bill insurance.

You are responsible for all fees regardless of insurance reimbursement.

B. Brand-Name Concierge Membership

The Concierge Support Membership is $129 every 28 days and includes telehealth coordination and administrative support services as outlined in the applicable Patient Services Agreement.

Membership fees are charged only if a licensed Provider issues a prescription following medical evaluation.

Membership:

  • Automatically renews every 28 days
  • Requires a three (3) billing cycle minimum commitment
  • Requires written cancellation at least 28 days prior to renewal
  • Fees are non-refundable once a billing cycle has begun

Medication costs are separate and paid directly to the dispensing pharmacy or manufacturer.

C. Compounded Program Fees

For compounded treatment plans, patients may pay a lump-sum program fee that includes telehealth coordination services and medication facilitation.

A portion of such fees may reflect pharmacy-related costs associated with prescription fulfillment pursuant to a valid prescription.

Once a telehealth consultation is completed or a compounded medication has been ordered, prepared, or dispensed pursuant to a valid prescription, applicable fees are generally non-refundable in accordance with pharmacy laws and program agreements.

7. Refund & Return Policy

Completed consultations, telehealth evaluations, administrative services, and membership billing cycles are non-refundable once rendered.

Prescription medications, whether FDA-approved or compounded, are generally non-returnable and non-refundable once dispensed, except as required by law.

Shipping issues must be addressed directly with the dispensing pharmacy.

8. No Guarantee of Results

Individual results vary.

We do not guarantee weight loss, body composition changes, metabolic improvement, or any specific treatment outcome.

Continued treatment depends on medical appropriateness as determined by your licensed Provider.

9. Eligibility

Services are intended for individuals 18 years of age or older, unless otherwise legally permitted with appropriate guardian consent.

10. Third-Party Providers & Vendors

We may utilize third-party vendors including:

  • Licensed pharmacies
  • Payment processors
  • Telehealth technology platforms
  • Scheduling systems

We are not responsible for delays, pricing changes, shipping errors, supply shortages, or actions taken by third parties.

11. Intellectual Property

All Website content, including text, graphics, logos, images, and software, is the property of Suncoast Trim Clinic, LLC and protected by intellectual property laws.

Unauthorized use is prohibited.

12. Limitation of Liability

To the fullest extent permitted by law, STC shall not be liable for:

  • Indirect or consequential damages
  • Loss of profits, revenue, or data
  • Clinical decisions made by independent Providers
  • Pharmacy-related issues
  • Third-party vendor actions

To the maximum extent permitted by law, STC’s total aggregate liability shall not exceed the total fees paid by you to STC in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms limits liability for gross negligence or willful misconduct where prohibited by law.

13. Indemnification

You agree to indemnify and hold harmless Suncoast Trim Clinic, LLC and its affiliates from claims arising from misuse of the Website, violation of these Terms, or false or misleading information provided by you.

14. Dispute Resolution & Arbitration

These Terms are governed by the laws of the State of Florida.

Any dispute arising from these Terms or use of services shall be resolved through binding arbitration in Sarasota County, Florida, in accordance with the rules of the American Arbitration Association.

You waive the right to a jury trial and to participate in class or collective actions.

You may opt out of this arbitration provision by providing written notice to Suncoast Trim Clinic within thirty (30) days of first accepting these Terms. The notice must include your full legal name, address, and a clear statement that you wish to opt out of arbitration.

This arbitration provision survives termination of services.

15. Privacy & HIPAA

We collect and use personal information in accordance with our Privacy Policy and Notice of Privacy Practices.

We comply with applicable privacy laws, including HIPAA where required.

16. SMS Text Messaging Terms

We may communicate via SMS regarding appointments, account matters, and care coordination.

Consent to receive SMS messages is not a condition of receiving medical treatment.

Message frequency varies. Standard carrier rates may apply.

You may opt out at any time by replying STOP.

We do not sell SMS consent or phone numbers to third parties for marketing purposes.

17. Accessibility

We strive to maintain an accessible Website. For assistance, please contact us directly.

18. Modifications to Terms

We reserve the right to update these Terms at any time. Continued use of the Website constitutes acceptance of revised Terms.
